
Tamil Nadu govt., Tasmac move Madras High Court against ED searches

State government and Tasmac challenge ED searches at Madras High Court, alleging violation of federalism principles.
The State government as well as Tamil Nadu State Marketing Corporation (Tasmac) have moved the Madras High Court jointly against the searches conducted by the Directorate of Enforcement (ED) at Tasmac’s headquarters in Chennai between March 6 and March 8 this year.
A Division Bench of Justices M.S. Ramesh and N. Senthilkumar on Wednesday accepted a request by State Government Pleader (SGP) Edwin Prabakar for an early hearing of the matter. The judges said the writ petitions could be heard on Thursday if they get numbered by then.
Later in the day, three writ petitions were filed in the Registry. The first writ petition, filed jointly by the State government and Tasmac, sought a declaration that the conduct of such searches by the ED, without the consent of the State government, was in violation of the principle of federalism.

In this writ petition, the petitioners had sought an interim direction to the ED to furnish true copies of the Enforcement Case Information Report (ECIR) based on which the agency had conducted the searches by invoking its powers under the Prevention of Money Laundering Act (PMLA), 2002.
The other two writ petitions were filed by Tasmac alone with one of them seeking a declaration that the search and seizure operation conducted between March 6 and 8 was illegal and the other seeking a direction to the ED not to harass the Tasmac employees in the guise of investigation.
In these two writ petitions, Tasmac had sought an interim direction to the ED to furnish to it a true copy of the search authorisation issued by ED Joint Director Piyush Yadav and also an interim injunction restraining ED from engaging in any form of harassment or intimidation of the Tasmac officials/employees under the pretext of investigation.
