Tirupparankundram row: HC allows Hindu Munnani to conduct ‘peaceful protest’

Madras High Court permits Hindu Munnani protest in Madurai with restrictions for public order and peace.
The right to freedom of speech and expression should always be subject to public order and peace and other restrictions imposed by the Constitution, the Madurai Bench of the Madras High Court observed on Tuesday while permitting the Hindu Munnani to conduct a “peaceful protest” on the Tirupparankundram row in Palanganatham junction in Madurai from 5 p.m. to 6 p.m.
The Hindu Munnani sought permission to conduct a protest in Tirupparankundram “to attract the attention of the government to protect the hillock from encroachment”. On February 2, Madurai City Police denied permission for the protest and on February 3, District Collector issued prohibitory orders under Section 163 of BNSS (Section 144 of CrPC).
A Division Bench of Justices G. Jayachandran and R. Poornima referring to the orders passed by the authorities observed the issue could have been handled in a better way. However, fortunately by consensus the issue has been substantially defused.
The court observed the organisers agreed to carry out their protest at Palanganatham junction instead of Tirupparankundram temple which will avoid inconvenience to the devotees. The police agreed to provide proper arrangement and protection for the demonstration at Palanganatham junction.
The protesters shall not carry more than one megaphone and the protest must be peaceful. No provocative slogans shall be raised which may cause disturbance to the public peace and tranquillity. The agitation should be fully videographed. The organisers should permit the police to videograph the agitation without any interference. The petitioners are responsible for the peaceful conduct of the protest, the court said and posted the matter on February 19.
