
Yes Bank case: CBI to file reply to bizman Avinash Bhosale’s plea challenging his arrest by June 22

The Bombay High Court has directed the CBI to file a reply to the plea of bizman Avinash Bhosale, who was arrested in the Yes Bank case, by June 22.
The Central Bureau of Investigation (CBI) will now have to file a reply to the petition filed by Pune-based businessman Avinash Bhosale challenging his arrest by June 22.
After the Bombay High Court asked the Central Bureau of Investigation (CBI) to file its say, Additional Solicitor General Anil Singh appearing on behalf of CBI sought time citing he had just received a copy of the petition. The court directed that the reply be filed by June 22 and kept the case for further hearing on June 23.

A writ petition was filed seeking declaration of the arrest of Bhosale illegal. Bhosale also sought setting aside of search proceedings conducted by the agency on April 30 and 31 and the order dated May 31, passed by the Mumbai district and sessions court, special judge, CBI, whereby Bhosale was sent to police custody till June 8 and his objections to his arrest were dismissed.
The impugned order has been passed by the special judge without taking into consideration the law laid down by the Supreme Court, stated Bhosale's plea.
Bhosale’s counsel Vijay Aggarwal said his arrest was ‘patently illegal’ and in ‘gross contravention’ of statutory provisions and without jurisdiction.
Aggarwal said his remand was discriminatory as CBI has filed a chargesheet against various accused persons and most of them were not arrested by the central agency, while Bhosale was arrested without any basis.
