Talaq-e-hasan: Supreme Court allows impleadment of husband in the case for settlement

The Supreme Court on Monday allowed the impleadment of husband in the case for settlement while hearing a Talaq-E-Hasan case.
Taking a humanitarian approach, the Supreme Court on Monday assured petitioners, who claimed to be victims of Talaq-E-Hasan, by saying that the court’s primary focus is to provide basic right of maintenance and other things for the women.
The court was hearing separate pleas filed by Benazeer Heena and Nazreen Nisha challenging the constitutional validity of the practice of Talaq-e-Hasan.
Appearing before a bench headed by Justice Sanjay Kishan Kaul, Benazeer explained how she was dumped by her husband who is a practicing lawyer and she doesn't have all means to raise her almost one-year-old son.
After hearing her, Justice Kaul assured her that, they have for now allowed impleadment of husband so that he can be bought on talking terms and settlement can be done.
Senior advocate Shyam Divan, appearing for Benazeer, told the court, "For now please allow us amendment of the memo of parties and issue notice to the husband."
The bench agreed and said though the larger issue needs to be addressed in these cases, but priority is that the women before us should get their basic right of maintenance and other things.
Senior advocate Ranjeet Kumar also told the court that his client is similarly placed, and permission should be granted to her also for impleading of husband.
