Supreme Courts orders warring AIADMK factions to resolve issues in general council meet

The dispute between the Edappadi K Palaniswami (EPS) and O Panneerselvam (OPS) factions could be resolved in the General Council of the party or in the civil suit pending before the high court, the top court noted.
The Supreme Court today issued a stay on the Madras High Court order barring the AIADMK general council from passing any “unannounced resolutions”. The dispute between the Edappadi K Palaniswami (EPS) and O Panneerselvam (OPS) factions could be resolved in the General Council of the party or in the civil suit pending before the high court, the top court noted.
During arguments, senior advocate Maninder Singh, appearing for AIADMK leader K Shanmugam argued that “an internal agreement” had been put in place for “joint control”.
“The person, who has been chief minister from 2017 till today, now wants to throw out the joint control that has been in place and make it unilateral.”
Senior advocate CS Vaidyanathan, appearing for the EPS faction, argued that the "high court would have limited jurisdiction in the internal management of a voluntary organisation, particularly a political party".

The bench of Justices Dinesh Maheshwari and Krishna Murari questioned the correctness of the High Court order.
"What happens within the party are matters which are happening there. Can an appellate court substitute its discretion for that of the internal party?" the bench remarked.
