Special Investigations Unit clears London police officer in man's death
CBC
The Special Investigations Unit (SIU) has cleared a London police officer in the death of a 34-year-old man while in custody earlier this year.
Fabian Hart was arrested for violating a court order on Feb. 1 and placed into a holding cell at around 3 :30 p.m. that day.
By 9 a.m. the next day, Hart said he wasn't feeling well.
Officers made arrangements to transport him to hospital when he began to shake and his condition deteriorated, purportedly due to alcohol withdrawal, said the release from the SIU.
Hart needed immediate medical attention before the ambulance came, and officers administered life-saving measures.
Paramedics took charge of Hart's care when they arrived and took him to hospital, where he died. His death has been attributed to methamphetamine – amphetamine toxicity.
Joseph Martino, director of the Special Investigations Unit, said it may have been advisable for the officer to take Hart to the hospital sooner.
But Martino found there was insufficient evidence to conclude that the officer's failure to do so deviated from a reasonable standard of care.
The SIU said the file has now been closed.
