Mumbai court refuses to close rape case against producer, orders action against complainant

A Mumbai court has refused to close a case of rape, cheating and criminal intimidation registered against a Bollywood film producer. The Mumbai Police had filed an application before a magistrate's court after concluding that the case was false.
While disposing of the application, the court directed the government lawyer to take legal action against the woman “who has taken the recourse of law and misused the provisions meant for needy litigants for her personal gain”.
The woman had, on one hand, filed an affidavit supporting the closure of the case by the police, while on the other, she had filed an FIR earlier alleging that she was sexually exploited by the accused for nearly three years with the promise of work in the film industry.
The FIR was lodged against the producer on July 15, 2021, for offences relating to rape, cheating and criminal intimidation.

The woman had listed out details of all the hotels and other places where she had been allegedly sexually assaulted by the accused and had also submitted WhatsApp chats and videos.
While directing the police station to continue the probe registered under sections 376 (rape), 420 (cheating), 506 (criminal intimidation) of the Indian Penal Code, the court said, “The senior police inspector of DN Nagar Police Station is directed to conduct further investigation into the matter as per law. The Divisional Commissioner of Police, Zone IX, is directed to monitor the investigation.”
