Misrepresenting mangalik status not grounds for divorce: Bombay HC

Dismissing a man’s divorce application, the Bombay High Court said that misrepresenting the mangalik status does not amount to cruelty.
The Nagpur bench of Bombay High Court refused to grant a divorce to a man, who accused his wife and her family of defrauding him by telling him the wrong date of birth at the time of marriage. The man claimed that his wife and her family changed the date to ensure that her horoscope says she is ‘mangalik’ even when she was not. The husband had first filed for divorce in the family court, which too had rejected his plea. He then filed an appeal in the high court. The bench of justices AS Chandurkar and NB Suryawanshi observed that the wife being a non-mangalik or having a different date of birth did not make out any case of cruelty.More Related News
