The bench said that there is an 80 per cent chance of the baby surviving. Thus, the court further directed the state government and the hospital to provide all necessary assistance if such a situation arises.
Kerala High Court on Saturday allowed a ten-year-old girl, allegedly impregnated by her father, to abort her child after 30 weeks of pregnancy.
A case of rape was filed by the girl's mother against her father to ensure a safe and healthy future for her daughter. The termination of pregnancy will be done at SAT hospital, Thiruvananthapuram.
The verdict was delivered by the court after a medical team confirmed that surgery could be performed to terminate the pregnancy. However, the bench said that there is an 80 per cent chance of the baby surviving.

Thus, the court has further directed the state government and the hospital to provide all necessary assistance if such a situation arises.
Calling the incident unfortunate, the court also said that society should be ashamed if the charges against the father were found to be true.
Under the existing law, an abortion could only be performed before 24 weeks of pregnancy. This had led the victim's mother to seek the permission of the court for termination.
