Karnataka hijab row: Govt’s affidavit in HC says prescribing uniform is state’s duty as per Constitution

The Karnataka government’s affidavit submitted in the High Court regarding the hijab row states that prescribing uniform is part of the fundamental duty of the state as per Article 14, 46 of the Indian Constitution.
An affidavit was submitted by the Karnataka government to the High Court regarding the ongoing hijab row in the state. The Karnataka HC, on Tuesday, February 8, commenced hearing petitions seeking to allow students to wear hijabs to schools and colleges.
The petition was filed by the six girls who were told not to attend classes while wearing hijab. This issue, which took place on January 1, 2022, in Udupi, was the initial incident that sparked the ongoing hijab row.
The Karnataka government’s affidavit stated, “while discharging the constitutional obligation of imparting education, the state has to prescribe a secular uniform dress code for the students.”

Among the other key points in the affidavit, it stated that prescribing the uniform also flows from the fundamental duty cast on the state under article 14 and 46 of the constitution.
The Karnataka government has also observed that every religion and caste will have their own belief, faith and practice.The affidavit also highlighted that many foreign countries have adopted this viewpoint and follow the same dress code in educational institutions.
The Karnataka High Court is set to resume hearing the petitions in the hijab row on Wednesday, February 9, at 2:30 pm.
