
'In-laws not living in same house': Court grants relief to elderly couple in domestic violence case

An elderly couple was granted relief by a Mumbai court in connection with a domestic violence case registered against them.
Stating that the in-laws were not staying under the same roof, a Mumbai court granted relief to an elderly couple in connection with a domestic violence case registered against them by their daughter-in-law.
The court held that visits as relatives and being in a domestic relationship are two different concepts. “In the case in hand, the daughter-in-law and son, since their marriage, were residing separately from the father-in-law and mother-in-law. Therefore, the daughter-in-law and son cannot be said to be having a domestic relationship with the parents-in-law, according to the Protection of Women from Domestic Violence Act (PWDVA),” judge Swati Chauhan said.
