Cheating case: Alibaba.com approaches Bombay HC against account freezing

A man had filed an FIR alleging that one of the business entities of Alibaba.com, namely Alibaba Cloud India LLP, was hosting a download link for a mobile app purportedly being used for cheating people.
Alibaba.com has approached the Bombay High Court against the freezing of its bank accounts by Maharashtra Police “on the pretext of investigating” an alleged cheating case.
An FIR was filed by a man who alleged that one of the business entities of Alibaba.com, namely Alibaba Cloud India LLP, was hosting a download link for a mobile application purportedly being used for cheating people.

The complainant claimed that after being lured with attractive returns, he made a payment of Rs 65,000 to the app. However, the application shut down mid-way and the person with whom the complainant coordinated, could not be contacted.
On the complaint, an FIR was registered and three months later. Mumbai police sent a notice under Section 91 to HSBC for freezing of accounts. It was this action of the police that the company has challenged in the high court.
The company in its plea said that the “police acted without application of mind as Alibaba had no business relationship with the offending entity, Alibaba Cloud India LLP.”
The plea stated that the police did not have the power to freeze the bank accounts. Alibaba.com also apprehended issuance of a letter to freeze another of its accounts in Citibank India.
