
Businessman Rahul Nanda, daughter absconding, ED gets orders for publishing proclamation

A Mumbai court has given orders to the ED to publish a proclamation against businessman Rahul Nanda and his daughter Rasshi Nanda.
The Enforcement Directorate (ED) has been permitted to publish a written proclamation requiring businessman Rahul Nanda and daughter Rasshi Nanda, to appear in the special court in Mumbai under the Presentation of Money Laundering Act (PMLA) within 30 days from the date of publication of the proclamation.
Kavita Patil, special public prosecutor, had moved an application on behalf of the ED to publish a proclamation requiring the accused Rahul Nanda and his daughter, 27-year-old Rasshi to appear in person before the Court within 30 days from the date of publication of such proclamation as envisaged under Section 82 (1) of Criminal Procedure Code.
Patil pointed out the report filed by the senior police inspector of Oshiwara Police Station, Mumbai that non-bailable warrants (NBW) that were earlier issued were taken to Nanda Villa in Andheri West for their execution on both of them.

However, the report indicated non-¬execution of the warrant as the premises mentioned in the address of the NBW were already sealed by the ED. The bungalow had been locked and no one had come to take resort therein. In the future, the officer said that he could not trace both these people. Patil said that the ED had tried to execute NBWs against both accused. However, both of them are not found on their known address.
Patil said that Nandas and their company were represented by advocates Ajit Singh and Madhukar Dalvi. However, since long, neither both the accused nor their advocates have turned to the court.
Special Judge MG Deshpande, after hearing Patil said, "I am of the opinion that, there is a reason to believe that both accused against whom a warrant has been issued by this court, have absconded or have been concealing themselves so that such a warrant cannot be executed. Therefore, this is a fit case to direct publication of a written proclamation requiring them to appear in this court within 30 days."
