Maharashtra BJP leader Pravin Darekar has approached the Bombay High Court seeking protection from any coercive action against him by Mumbai police, in a bank fraud case.
Bharatiya Janata Party (BJP) leader Pravin Darekar has approached the Bombay High Court for protection from any coercive action against him by Mumbai police, in a case of alleged bank fraud.
A Mumbai sessions court had earlier rejected Darekar's anticipatory bail plea. Judge RN Rokade said that Darekar is a member of Maharashtra Legislative Council (MLC) and an influential person in the Mumbai District Central Cooperative Bank. The bank officials are witnesses in the case against Darekar.

"Apprehension of the prosecution of tampering of evidence cannot be firmly ruled out. If Darekar is equipped with such an order before he is interrogated by the police, it would greatly harm the investigation and would impede the prospects of unearthing of ramifications involved in the conspiracy. The public interest also would suffer as a consequence," said Judge Rokade.

Judge Rokade had further noted that the allegations of forgery against Darekar were based on the record prepared in respect of his membership in Pratidnya Labour Society.
"It is seen from the allegations that public funds were transferred to Darekar. It is seen from the say of the prosecution that the society is not functioning on the given address. In the entire gamut of the circumstances and peculiar facts of the case, in my considered view, Darekar has not made out a prima facie case for grant of pre-arrest of bail," said the judge.
