Justice Bharati Dangre of the Bombay High Court allowed Neil Somaiya, son of BJP leader Kirit Somaiya, to withdraw his petition for anticipatory bail.
The plea was withdrawn after an officer from the Economic Offence Wing (EOW) of the Mumbai Police made a statement that there was no complaint against Neil Somaiya at present and thus no preliminary enquiry was being conducted either.
As there was no apprehension of arrest, so advocates representing Neil Somaiya withdrew the anticipatory bail plea.
Earlier, Somiaya’s petition was rejected by the sessions court of Mumbai. Additional Sessions Judge DL Bhagwat, while rejecting the anticipatory bail application, said, "Having considered all the material before this court and the oral contentions on behalf of Somaiya, factual matrix as put forth on behalf of Somaiya before this court is vague and no blanket order can be passed on such vague factual matrix, particularly when no complaint has been made to the Economic Offences Wing (EOW), leave apart registration of crime against Somaiya."
Somaiya's lawyer Ashok Mundargi had requested to grant relief in the nature of directions to the EOW to give to the applicant, 72 hours' notice prior to his arrest in the eventuality of registration of FIR. Somaiya claimed that he apprehended arrest in the event of criminal complaint being lodged against him at the instance of Shiv Sena MP Sanjay Raut.
Sanjay Raut had accused Somaiya and his father of being involved in a land deal with Rakesh Wadhwan in Vasai, complaints of extortion, and the PMC bank scam. The Shiv Sena leader had stated that he had presented evidence of criminal acts against Kirit and Neil Somiaya to the Chief Minister and Home Minister of Maharashtra.
Mundargi had argued that all the allegations against Somaiya are false. "However, the allegations were being made by powerful person, so Somaiya apprehends his arrest. There has been history that prominent individuals who made allegations against the ruling party of the state, were arrested atodd hours without prior notices," Mundargi had argued.
