India Today
A revision writ petition has been filed against those acquitted in the Babri Masjid demolition challenging the special CBI court’s order that acquitted all the accused in the case including top BJP leaders LK Advani, Murli Manohar Joshi and Uma Bharti.
A new twist has come to the fore in the Ayodhya Ram Mandir-Babri Masjid dispute case. A revision writ petition has been filed against those acquitted in the Babri Masjid demolition in Lucknow Bench of Allahabad High Court on behalf of Haji Mehboob and Syed Akhlaq Ahmed. While the case was filed six months back, it is going to be heard tomorrow on July 18.
REASON FOR TRIAL
The Babri demolition case was first registered in the Ram Janmabhoomi police station of the then Faizabad district. Initially, the Uttar Pradesh Police was investigating this but later the matter was handed over to the CBI. After a long investigation, the special CBI court in Lucknow had considered the incident to be accidental rather than planned. The court had ruled out the conspiracy theories in the December 1992 incident in which the Mughal-era monument was razed to ground by a mob of kar sevaks. That is why all the accused in this case were acquitted.
Haji Mehboob, who was a party of the Babri Masjid, has filed a revision writ petition on behalf of Syed Akhlaq Ahmed in the Lucknow Bench of the Allahabad High Court. The serial number of this petition is 806. Rafat Farooqui, Najam Zafar, Khaleq Ahmed are going to defend the case on behalf of Haji Mehboob and others. Shiv Prasad Shukla will be seen standing in their opposition.
As many as 32 people were accused in the Babri demolition case, including top BJP leaders LK Advani, Murli Manohar Joshi, Sadhvi Ritambhara, Nritya Gopal Das, president of the existing Ram Mandir Trust, Uma Bharti and BJP leader Vinay Singh, who led the Ram temple movement. At present, more than 17 of these people have died. Now, the petition for convicting the remaining accused has been made in this writ petition.
During the Ram Mandir movement, separate cases were registered in the Ram Janmabhoomi police station of the then Faizabad district regarding the demolition of Babri masjid. Many big leaders of the BJP were named in this case, including LK Advani and Murli Manohar Joshi.
The entire matter was transferred from the UP Police to the CBI and the matter was heard in the CBI court itself. After which the court had acquitted all the accused. It was argued on behalf of the Hindu side that it was actually a Ram temple and the dilapidated temple was demolished for restoration. After this, the Supreme Court gave its decision in favour of Hindus and, in the view of the SC order, the grand Shri Ram Janmabhoomi temple is being constructed. In the same decision, the SC also directed the government to allocate a separate 5 acre land for construction of a mosque.
