
Attorney general to reply to UAPA provisions challenged by Anand Teltumbde in Bombay HC

Bombay High Court has requested the attorney general's assistance in a plea filed by Elgar Parishad accused Anand Teltumbde, challenging provisions of UAPA.
Bombay High Court has sought the assistance of Attorney General of India, KK Venugopal, in a plea filed by Elgar Parishad accused Professor Anand Teltumbde.
Teltumbde has challenged provisions of the Unlawful Activities (Prevention) Act (UAPA).
The writ petition, filed by advocate Devyani Kulkarni, has challenged bail provisions under the UAPA and alleged misuse of the term "front organisation" by the National Investigation Agency (NIA).
The matter is being heard before the division bench of Justices AB Shukre and GA Sanap.
Advocate Mihir Desai, appearing for Teltumbde, pointed out that neither UAPA nor any rules defined what a 'front organisation' was.
Desai submitted that the only way an organisation could be declared "banned" after the central government notified the same or added it under the schedule of the UAPA.
Teltumbde's contention was that the first schedule of the UAPA not only included individual organisations, but also all their formations and front organisations. The definition of "front organisation" was very broad and misused by the NIA, the petition stated.
