The Allahabad High Court has granted conditional bail to a person accused of carrying out murderous attack on people who raised 'Jai Shri Ram' slogans.
The court has ordered the release of the accused on a personal bond of Rs 50,000 and two sureties.
Justice Jayant Banerjee gave this order on the application of Irfan, a resident of Simbhauli, Hapur. It is worth mentioning that on the date of the incident a clash took place between two groups after members of one raised slogans of 'Jai Shri Ram' outside the house of one named Yasin. This led to protests from the other party and eventually resulted in a clash breaking out.
People were injured from both sides. An FIR had been lodged in Simbhauli police station in connection with the incident against the accused Irfan under sections 147, 148, 504, 307, 324 of the IPC.
The counsel for the applicant submitted before the High Court that he is innocent and has been falsely implicated in the present offense and that he has also suffered injuries.
It was further submitted that the injured and the complainant did not allege any of the accused persons to have a specific role and the accused person had a general role. It was also said that there is no apprehension that he might run away from law after being released on bail and the applicant is in jail since March 11, 2022.
It was argued that it is a matter of equality as other co-accused have already been granted bail by this court. The petitioner submitted that the accused did not have any criminal history, and he has been framed. He was not at the scene of the incident.
