A Maharashtra panchayat election case in court over mistyped middle name

A candidate disqualified to contest polls won the Maharashtra panchayat election last year. She took advantage of a typographical error in the disqualification order. Now, the Bombay High Court has found her guilty of fraud.
She won the Maharashtra panchayat polls last year in Solapur. But the Bombay High Court has now ordered action against her for fraud. Reason, the collector mistyped her middle name and she took advantage of the mistake.
Her name is Nagarabai Palave. She won the panchayat election in January 2021 from ward number-four in the Mandave village panchayat in Malshiras Taluka of Maharashtra’s Solapur.
Her election was challenged by Tanaji Palave, who got elected as the member of the Panchayat Samiti from ward number-five.
Tanaji Palave cited a 2016 order issued by the district collector, who is also the district election officer, disqualifying Nagarabai Palave from contesting the polls for five years. The election ban was still in force when the panchayat polls were held on January 15 last year.

The Bombay High Court has now directed the Solapur collector to initiate appropriate steps against Nagarbai Palave under the provisions of the Maharashtra Village Panchayats Act and in accordance with other laws dealing with misrepresentation and fraud.
The division bench of Justices SJ Kathawalla and MN Jadhav was hearing a petition filed by Tanaji Palave.
